This is a complete course of study providing education and training to enable the student to learn how to deal with the duties imposed by a corporate liability insurance policy on the insured. We review and understand the wording of the commercial general liability insurance policy. The course explores the importance of a representative of an insured being aware of what is required of an insured to allow an insurer to complete a thorough investigation of a liability claim made against the insured and to assist the insurer in its obligation to defend and indemnify the insured against tort claims the risk of loss which was insured against.

The Course covers the following:

  1. The duties imposed on an insured by a liability insurance policy.

  2. The basic wording of the commercial general liability insurance policy imposing conditions on the insured.

  3. How to deal with the notice condition contained in the liability policy.

  4. How to deal with the clause requiring the insured to cooperate with the investigation of the insurer.

  5. How to avoid making voluntary payments in violation of policy conditions.

  6. When and why an insured can consider suing the insurer.

  7. How to deal with “other insurance” provisions of liability policies when more than one insurer has agreed to defend and indemnify the insured.

  8. How to deal with premium audits.

  9. The importance of accurate representations made to the insurer in the application and in claims presentations.

  10. How to deal with the separation of insureds when more than one insured is involved.

  11. The importance of the insurer’s right to subrogation.
